One application to the EUIPO protects your brand in all 27 EU member states. We handle clearance, filing, examination and oppositions for businesses inside and outside the EU, on fixed fees.
How do you register an EU trademark? You file one application with the European Union Intellectual Property Office (EUIPO) in Alicante. Once registered, the EU trademark (EUTM) protects your brand in every EU member state for 10 years and can be renewed indefinitely. The EUIPO examines the application, publishes it, and allows three months for third parties to oppose. Unopposed applications typically register within about four to six months. Official fees start at €850 for one class. Since 1 January 2021 an EU trademark no longer covers the United Kingdom.
Businesses with no domicile, principal place of business or real and effective establishment in the European Economic Area can file an EU trademark application themselves, but must be represented before the EUIPO in every step after filing: examination objections, oppositions, cancellation actions and appeals (Article 119(2), EU Trade Mark Regulation). In practice, most non-EU brand owners appoint a representative from the start.
As Cyprus advocates, we are entitled to act as representatives before the EUIPO (Article 120(1)(a)). We act for:
Before you file, we search the EU and national registers for identical and similar earlier marks and tell you in writing how risky the application is, and how to reduce that risk.
We draft the list of goods and services under the Nice Classification, file the application with the EUIPO and handle any examination objections through to registration.
We file oppositions against conflicting applications and defend your application if a third party opposes it, including negotiating coexistence or settlement where that serves you better.
We monitor renewal deadlines, renew on time, and record transfers, licences and changes of name or address so your register entry stays accurate.
You pay two things: our professional fee and the EUIPO's official fee. Both are set out below in euro. Our fees are exclusive of VAT where applicable.
| Service | Our fee | EUIPO fee |
|---|---|---|
| EU trademark registration, one class: clearance search, filing and handling to registration | €450 | €850 |
| Second class | €75 | €50 |
| Each additional class | €100 | €150 |
| Clearance search only, with written advice | €200 | – |
| Renewal, one class | €250 | €850 |
| Filing an opposition | €500 | €320 |
| Defending an opposition: first written response | from €600 | – |
Official fees are those for electronic filing set by the EU Trade Mark Regulation and are paid to the EUIPO without VAT. Further rounds of evidence and argument in opposition proceedings are charged by time, and we agree an estimate with you first. Eligible EU-based SMEs may be able to recover part of the official fees through the EUIPO's SME Fund; see our step-by-step guide for the current position.
For one class, our fixed fee is €450, which includes a clearance search, filing and handling to registration, plus the EUIPO's official fee of €850. A second class adds €75 plus €50 official fee, and each further class €100 plus €150 official fee.
An application that meets no objection or opposition typically registers in about four to six months. The three-month opposition period after publication is fixed; an opposition or examination objection will extend the timeline.
No. Since 1 January 2021 EU trademarks no longer cover the UK. UK protection needs a separate UK trademark from the UK Intellectual Property Office.
If your business has no domicile, principal place of business or real establishment in the European Economic Area, you may file the application yourself but must be represented in all later proceedings before the EUIPO. EU businesses are not obliged to use a representative, but a clearance search and a well-drafted specification avoid the most common causes of refusal and opposition.
The EUIPO normally allows a two-month cooling-off period for the parties to settle, which can be extended. If no settlement is reached, both sides file written evidence and arguments and the EUIPO decides. We file the first written response for a fixed fee from €600 and agree an estimate for any further stages.
Every 10 years from the filing date. The official renewal fee is €850 for one class when renewed electronically; our fee is €250. Renewal can be requested in the six months before expiry, with a further six-month grace period for an additional fee.
Tell us your brand, your goods or services and where you trade. We will reply with a fixed-fee quote.
