Our firm is pleased to announce a successful outcome in a professional negligence case before the District Court of Nicosia. In a judgment delivered today, the Court ruled in favour of our client, awarding general damages against a well-known hair salon chain and its employee.
The Case - No. 869/2024
Our client sustained an injury to his ear lobe during what should have been a routine haircut. Due to the negligence of the hairdresser, our client suffered a cut to his ear lobe resulting in a permanent scar and mild deformity. The injury caused him physical pain, discomfort, and ongoing psychological distress affecting both his social and professional life.
The Legal Framework
The claim was brought under the Civil Wrongs Law, Cap. 148, which establishes the duty of care owed by professionals to their clients. Under Article 51 of the Law, any person who practises a profession or provides services for remuneration owes a duty of care to exercise the skill and diligence expected of a reasonably competent professional in that field.
A key aspect of the case involved the principle of vicarious liability under Article 13 of Cap. 148, which holds employers responsible for the negligent acts of their employees committed during the course of their employment.
The Outcome
The Court found that the hairdresser had breached his duty of care and that the injury sustained by our client was not a mere error of judgment but demonstrated a failure to maintain the required standard of skill and attention expected of a competent professional. The Court further held that the employer company was vicariously liable for the employee’s negligence.
Judgment was entered in favour of our client for €1400 general damages plus legal interest and costs.
